Terms of Service

Rules for using Qardápio as a restaurant-menu SaaS, including accounts, content, intellectual property, and liability limits.

These Terms of Service govern access to and use of Qardápio, a SaaS product for creating digital menus, public menu pages, and restaurant QR codes.

Qardápio is provided by Artizan. Contractual or legal questions should be sent to geral@artizan.pt.

Eligibility and accounts

By using Qardápio, you confirm that you have authority to act on behalf of the restaurant or business you create or manage on the platform.

You are responsible for keeping access to your authentication devices and email secure and for activity carried out through your account.

Permitted use

The service is intended for creating, managing, and publishing digital restaurant menus and related materials.

  • You must not use Qardápio for unlawful, misleading, defamatory, offensive, or rights-infringing content.
  • You must not try to bypass technical limits, exploit vulnerabilities, copy parts of the service improperly, or interfere with platform availability.
  • You are responsible for the accuracy of prices, descriptions, allergens, images, and other information published in your menu.

User content

You retain ownership of the content you upload to Qardápio, including text, images, logos, and restaurant information.

By uploading content, you grant Artizan a limited, non-exclusive, revocable license to host, process, display, and distribute that content as required for the normal operation of the service.

Platform intellectual property

The Qardápio software, product identity, interface, design, code, documentation, and other platform elements belong to Artizan or its licensors.

These Terms do not transfer any intellectual property rights in the platform to you, other than the limited right to use the service in accordance with these Terms.

Availability, changes, and support

Artizan may update, improve, fix, or change Qardápio at any time, including features, limits, and technical components.

While we aim to keep the service available and reliable, Qardápio is provided on a reasonable-availability basis and may experience interruptions, maintenance windows, errors, or temporary downtime.

Paid plans and billing

As of these Terms, Qardápio presents paid plans as a future possibility and the publicly available product experience remains centered on the free plan.

If paid features, subscriptions, or charges are introduced or become applicable, additional commercial terms, Stripe-based billing, renewal, cancellation, and invoicing rules may apply to those services.

Suspension and termination

Artizan may suspend or terminate access if there is evidence of abusive use, a breach of these Terms, a security risk, a legal requirement, or conduct that threatens the platform or third parties.

You may stop using the service at any time. Obligations that should survive by their nature, including intellectual property, liability, and legal compliance provisions, remain in effect after termination.

Limitation of liability

To the fullest extent permitted by law, Artizan is not liable for indirect losses, lost profits, lost data, lost business, reputational harm, or damages arising from service unavailability, third-party misuse, or content published by the user.

Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.

Governing law and jurisdiction

These Terms are governed by Portuguese law. Unless mandatory law requires otherwise, disputes relating to Qardápio will be submitted to the competent courts in Portugal.
